The USCIS Immigrant Investor Program (also known as the “EB-5 Program”) was established by Congress in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors. Under the EB-5 Program, foreign investors can obtain lawful permanent residency (also known as a “green card”) through either a direct investment or investment through a USCIS designated Regional Center. In either instance, the requirements are essentially the same—investment of $1 million in a new commercial enterprise that creates or preserves at least 10 full-time jobs for qualifying U.S. workers within 2 years of the grant of conditional permanent residency. If the new commercial enterprise is located in a Targeted Employment Area (high unemployment or rural area), the qualifying investment is $500,000.
